Anna's favorite saying is that it is easy to create a prenuptial agreement, but the difficult part is ensuring it is enforceable. Of course, if an agreement is not enforceable, it is worthless. A search of the internet shows there are many prenuptial agreements online. However, many of these agreements are not based on California law and many use out of date law. Anna prides herself in her current agreements that continue to evolve based on changes in family law. Anna requires there to be attorneys on both sides of any agreement that she drafts or reviews. Without both parties being informed of their rights and being counseled about the ramifications of a prenuptial agreement, there is little chance it will be enforceable. California has very specific requirements regarding timing and disclosures that are required to ensure that a prenuptial agreement is valid. We will inform you of these and document your compliance within the prenuptial agreement.
We suggest that you contact our office at least six months prior to your wedding. We will request a list of assets from both parties and discuss your desires for the agreement. Upon being retained, we will prepare a first draft and after your review, we suggest sharing it with your significant other. Often there are changes to the agreement at this point. Then your significant other retains an attorney to review the agreement and changes may be requested. After the parties agree on the language in the agreement, all the parties sign the agreement and have it notarized.
